Master Pilates — Website Terms of Use

In these Terms, “we”, “us”, “our” and “Master Pilates” means Ann Wilde trading as Master Pilates South Yarra ABN 81 245 392 135 and “Website” means the website at the URL address www.masterpilates.com.au which includes content that is posted or embedded via third-party services at that address.

1. Your acceptance

In consideration for your Use of this Website, you agree to these terms and conditions.

Your use of this Website may consist of:

a. using, browsing or accessing any part of the Website;

b. registering an account on the Website; 

c. participating in or viewing our Pilates exercise instructional videos (“Pilates Instruction”);

d. purchasing our goods or services; or

e. communicating with us

(“Use”).

We may from time to time review and update these Terms to take account of new laws, regulations, products or technology. Your use of the Website will be governed by the most recent Terms posted on the Website. By continuing to use the Website, you agree to be bound by the most recent Terms. It is your responsibility to check the Website regularly for updated versions of the Terms.

2. Express assumption of risk 

The Pilates Instruction is provided as-is and we make no warranty, representation or guarantee as to the suitability for your personal conditions.

Through your participation in the Pilates Instruction, you:

a. acknowledge that performing pilates exercise can involve risk of personal injury;

b. voluntarily assume all risks and dangers associated with participating in the Pilates Instruction; and

c. declare that you are medically or physically fit to undertake and participate in the Pilates Instruction offered.

3. Limitation of Liability

To the full extent permitted by law, Master Pilates excludes all warranties, whether express or implied, including any warranties or representations concerning the availability of the Website, quality, completeness, accuracy, suitability, acceptability or fitness for purpose in relation to the Website, the conduct of any instructors or other users, all links to or from the Website and the goods and services advertised or accessible on the Website.

Subject to the consumer guarantees provided for in consumer protection legislation (including the Australian Consumer Law), Master Pilates excludes all liability for any loss, damage, claim, cost or expense whatsoever arising out of or in connection with these Terms, the Website, and any goods and services advertised, accessible or sold on the Website.

4. Intellectual property

All intellectual property rights, including copyright in the Website, Master Pilates goods and services, and all components of them are owned or licensed by Master Pilates or our related entities and are provided to you under license for your personal domestic private use only. You must not copy, modify or transmit any part of the Website other than for your own personal domestic private use.

5. Access to the Website

We may at any time immediately terminate your access (including restricting access) to the Website or any feature of the Website, including your account, for any reason (including due to your breach or alleged breach of these Terms) in our sole discretion and without prior notice to you.

6. Warranty 

You warrant that you have full power to enter into this Release and enter into this on behalf of yourself and any minors over which you have responsibility or supervision.

7. Governing Law

This Release shall be governed by the law in Victoria, Australia, and any dispute arising in relation to this Release shall be heard by the Courts of that State.
